1. Agreement

These Terms of Use (“Terms”) are an agreement between you and Yiğit Efe Toz, an individual developer based in Türkiye, who operates Palmie (“Palmie”, “we”, “us”). They govern your use of the Palmie app for iPhone, the website thepalmie.com and related services (together, the “Service”). By downloading or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who can use Palmie

You must be at least 13 years old, or older if your country requires a higher age to consent to the processing of personal data or to enter a binding agreement. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian, and a parent or guardian must make any purchase. You must not use the Service if applicable law bars you from doing so.

3. License and Apple terms

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices you own or control, for your own non-commercial travel planning, subject to these Terms and the Apple Media Services Terms and Conditions, including the Usage Rules.

Because you get the app from Apple's App Store, these Terms are between you and Palmie only, not Apple. Palmie, not Apple, is responsible for the app and its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to the app or your possession or use of it, including product liability, failure to meet legal or regulatory requirements, consumer protection and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you. If you have a question or complaint about the app, contact us at the address in section 23. You must also comply with the terms of any third-party agreements that apply when you use the app, such as your wireless data agreement.

4. Your account

Palmie uses Sign in with Apple. You are responsible for the security of your Apple ID and device and for activity that takes place through them. Tell us promptly if you believe your account has been used without your permission. You can delete your Palmie data and sign out at any time with Account → Delete Account. Deleting your account does not cancel an App Store subscription; cancel it in your Apple ID settings.

5. AI-generated content

Localizer and our plan generators use artificial intelligence. Their output is provided for general information and inspiration only. It may be inaccurate, incomplete, biased or out of date, and places may be closed, moved, renamed or no longer exist. Prices, opening hours, availability, transport, visa and entry rules, health requirements, weather, local laws and customs can change at any time. You are responsible for checking important details with official or primary sources before you rely on them, and for your own decisions about where to go and what to do.

AI output is not professional advice of any kind, including legal, immigration, medical, financial or safety advice, and it is not a booking or a guarantee. Output may be similar to output given to other users. You must not rely on it for decisions that could harm you or others if it were wrong.

6. Travel, safety and SOS

Use common sense and local guidance. Travel involves risk. Check government travel advisories and local conditions, and follow the instructions of local authorities.

The SOS section lists emergency telephone numbers compiled from public sources. We try to keep them accurate but cannot guarantee that they are correct, complete or current for every location, and the feature is not a substitute for calling local emergency services or for your own preparation. If you are in danger, contact local emergency services immediately. Maps, routes and directions may be inaccurate or unavailable; always use your own judgment, obey traffic rules and avoid using the app while driving, cycling or walking in traffic. Downloaded offline map areas are images of a map at the time of download; live directions need an internet connection. You are solely responsible for your safety, your health and your belongings while you travel.

7. Purchases and subscriptions

Some features require payment. All purchases are made through the Apple App Store and are subject to Apple's terms. Prices are shown in the App Store in your local currency and include applicable taxes where required.

  • Palmie Plus is an auto-renewing monthly subscription. Payment is charged to your Apple ID account at confirmation of purchase. Plus includes unlimited Localizer questions, offline maps, saved places and conversations, personal suggestions and no ads. Features may change over time.
  • The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you chose.
  • You can manage or cancel your subscription at any time in Settings → your name → Subscriptions on your iPhone. Deleting the app does not cancel a subscription. If you cancel, you keep access until the end of the paid period.
  • Any unused part of a free trial or introductory offer, if one is offered, is forfeited when you purchase a subscription.
  • Remove Ads is a one-time, non-subscription purchase that turns off ads on your Apple ID's devices. You can restore it on your other devices with the same Apple ID. It does not include Palmie Plus features.
  • Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves. This does not affect any right you have under mandatory consumer law.
  • Right of withdrawal. If you are a consumer in the EU, the UK, Türkiye or another country with a statutory right to withdraw from distance contracts, that right may not apply, or may end, once a digital service has started with your consent, as the law allows. Apple presents this when you buy; nothing in this section limits rights that cannot be waived.
  • Price and feature changes. We may change prices, limits (such as the number of free questions per conversation) and features. We will not change the price of an active subscription period. Where Apple requires your consent to a price increase, we will ask for it through Apple.

8. Free version, ads and rewarded videos

The free version is supported by ads and has limits, for example five free Localizer questions per conversation. You may watch an optional rewarded video to unlock additional questions. A reward is granted when the ad completes as Google's ad SDK reports it; if an ad does not load or is closed before it finishes, the reward may not be granted. We may change free limits, the frequency of ads and the rewards at any time. You must not use any method to skip, block, automate or fake ads or to bypass limits.

9. Acceptable use

You agree not to:

  • break the law or infringe anyone's rights;
  • reverse engineer, decompile, scrape or copy the Service, or attempt to extract keys, tokens or source code, or bypass its limits, security, subscriptions or paywalls;
  • use the Service to harass, threaten, defame or harm others, or to generate unlawful, hateful, violent, deceptive or sexually explicit content, or any sexual content involving minors;
  • attempt to make the AI produce harmful content, or use it to plan illegal activity;
  • disrupt or overload the Service or the third-party services it relies on, or send automated requests to our gateway;
  • use the Service to build a competing product, train other AI models or resell it; or
  • impersonate others or misrepresent your affiliation with anyone.

10. Your content and feedback

You keep ownership of what you write and create in Palmie, such as chats, saved places and notes. You give us only the permission needed to process that content to operate the Service for you, including sending it to the providers described in our Privacy Policy. As between you and us, you may use the output generated for you for your personal purposes, subject to applicable law and the terms of the AI provider. You are responsible for what you share with others using the share feature. If you send us feedback or ideas, you give us a free, worldwide, perpetual license to use them without obligation to you.

11. Our property

The Service, including the Palmie name, logo, design, text, software and the way the content is arranged, belongs to Palmie or its licensors and is protected by copyright, trademark and other laws. These Terms give you no rights in them other than the license in section 3. Place names, event listings, logos and trademarks of third parties belong to their owners. Apple, the Apple logo, iPhone and App Store are trademarks of Apple Inc.

12. Third-party services

The Service relies on and links to services run by others, including Apple (maps, sign-in, payments), our AI provider, Cloudflare, Ticketmaster and Google AdMob. We do not control them and are not responsible for their content, availability, accuracy or practices. Bookings and purchases you make on third-party sites, including hotel, flight and ticket sites, are between you and that third party, and their terms apply.

13. Copyright and content complaints

If you believe that content in or linked from the Service infringes your rights, email [email protected] with your contact details, a description of the work and where it appears, and a statement that you are the rights holder or authorized to act for them. We will review the notice and act as the law requires, which can include removing content or ending access for repeat infringers.

14. Export controls and sanctions

You may not use or export the Service in violation of applicable export-control or sanctions laws, including those of the United States, the European Union, the United Kingdom and Türkiye. You confirm that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.

15. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not guarantee that the Service, or any itinerary, place, event, route or emergency number it shows, will be accurate, safe, available or suitable for you, or that it will work without interruption on every device or network.

Nothing in these Terms limits any warranty or right that you have under mandatory consumer protection laws that cannot be excluded.

16. Limitation of liability

To the maximum extent permitted by law, Palmie and its team, partners and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, bookings or travel expenses, arising from or related to your use of, or inability to use, the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us through the App Store for the Service in the 12 months before the claim and (b) USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, for intentional misconduct or gross negligence, or any liability that mandatory consumer law gives you.

17. Indemnity

If you are not a consumer, you agree to defend and indemnify Palmie against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service. If you are a consumer, this section applies only to the extent permitted by the law of your country.

18. Ending your use

You can stop using the Service at any time by deleting the app (and cancelling any subscription in your Apple ID settings). We may suspend or end your access if you breach these Terms or if we need to protect the Service, other users or the law, and we may change or discontinue features at any time. Sections that by their nature should survive termination will do so.

19. Events beyond our control

We are not responsible for failures or delays caused by events beyond our reasonable control, including outages of Apple, our AI provider, our hosting provider or the internet, natural disasters, war, labor disputes, government action or changes in third-party terms.

20. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Before starting a formal dispute, please contact us at [email protected] so we can try to resolve it informally. If we cannot, the courts and enforcement offices of Istanbul, Türkiye, have jurisdiction, except that:

  • if you are a consumer, you keep the benefit of any mandatory consumer-protection rules of your country of residence, you may bring proceedings in the courts of your country of residence where the law gives you that right, and, in Türkiye, you may apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or Consumer Courts;
  • if you are in the EU, you can also use the European Commission's online dispute resolution platform where it is available.

We do not require you to give up the right to go to court, and nothing here asks you to waive your right to bring or join a class or collective action where the law of your country gives you one.

21. Changes to these Terms

We may update these Terms as Palmie evolves. We will update the date at the top of this page and, for material changes, give you notice in the app or by another suitable method. If you keep using the Service after the changes take effect, you accept the updated Terms. If you do not agree, stop using the Service and cancel any subscription.

22. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a part is found unenforceable, the rest stays in effect. If we do not enforce a right, we do not waive it. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition or sale of assets. These Terms are written in English. Translations are for convenience, and if they differ, the English version prevails unless the law of your country says otherwise. We may send you notices in the app, on this website or by email.
